General Terms and Conditions (GTC)
1 General Version dated: 10.07.2026
1.1 These General Terms and Conditions ("GTC") apply to orders, sales, and deliveries of products ("Products") offered and sold in this online shop ("Webshop") via the website https://jmtp.at.
1.2 The contract language is German
2 Scope of Application
2.1 These GTC apply where the buyer is a consumer within the meaning of § 1 KSchG (Austrian Consumer Protection Act) ("Customer").
3 Changes to the GTC
3.1 The Provider reserves the right to amend these GTC. The GTC in effect at the time the purchase is concluded shall apply to the sale of Products.
4 Customer Account
4.1 To order Products, the Customer may create a customer account in the Webshop. Creating the customer account requires the Customer to provide certain information.
An order is also possible without a customer account.
5 Order, Order Confirmation, Shipping Confirmation
5.1 The ordering process consists of the following steps:
Selecting the desired goods Placing the goods in the shopping cart Entering personal details Selecting the payment and delivery method Reviewing and, if necessary, correcting the order Submitting the binding order by clicking "order with obligation to pay"
5.2 The Products and prices displayed in the Webshop constitute an invitation to the Customer to submit a binding offer to the Provider to purchase the Products ("Order"). By clicking the button labeled "order with obligation to pay", or an equivalent wording, the Customer submits a binding order to the Provider. Images and drawings of the goods are approximate only, unless expressly stated as a fixed value for the product. The Customer accepts minor and objectively justified changes.
5.3 The Provider will promptly send the Customer a confirmation, to the email address provided by the Customer, that the order has been received by the Provider ("Order Confirmation"). This Order Confirmation does not constitute acceptance of the Customer's order but merely confirms receipt of the order by the Provider.
5.4 Acceptance occurs at different times and in different forms depending on the payment method chosen:
by sending an order acceptance confirmation via email, whereby the time of receipt of the order acceptance confirmation by the Customer is decisive. by shipping the ordered goods to the Customer, whereby a transmitted shipping confirmation is to be understood as an order acceptance confirmation. If no separate shipping confirmation is sent to the Customer, the time of receipt of the goods by the Customer is decisive. by sending a payment request.
5.5 The Customer must ensure that all information provided as part of an order, in particular the data required for shipping, is accurate, correct, and up to date. The Customer must notify the Provider of any changes to this information without delay.
5.6 After the contract is concluded, the Provider will send the Customer an electronic invoice. The Customer agrees to receive an electronic invoice.
6 Payment Terms
6.1 All stated prices are in euros, inclusive of VAT but exclusive of shipping costs, unless stated otherwise. Shipping costs will be shown to the Customer before the order is submitted.
6.2 Payment in the Webshop can be made using the following payment methods: credit card, Klarna, Apple Pay, PayPal, Google Pay.
6.3 Shipping costs depend on the order and will be disclosed by the Provider before the order and in the Order Confirmation.
7 Delivery
7.1 The Customer may choose from the shipping methods specified by the Provider in the Webshop.
7.2 The delivery dates stated by the Provider are based on the information provided by the contracted shipping service provider. Unless a different delivery date is specified for the relevant product, delivery of the Products to the Customer shall take no more than 30 days from conclusion of the contract.
7.3 If the delivery date is not met due to force majeure, labor disputes, or other events beyond the Provider's control, the delivery date shall be extended reasonably for the duration of the obstacle. The Provider will inform the Customer of the beginning and end of such circumstances as soon as possible, without the Customer being able to derive any claims from a failure to provide such notice.
7.4 If the Customer is in default of accepting the Products, the warranty period for the Provider's performance shall begin at that time.
8 Retention of Title
8.1 The Provider retains title to the Products until the purchase price and any incidental costs (in particular shipping costs) have been paid in full by the Customer.
9 Default by the Provider
9.1 If the Provider is in default with its performance, the Customer must first request the Provider to perform within a reasonable grace period of two weeks. If the Provider fails to perform within this period, the Customer may withdraw from the contract or continue to demand performance.
10 Warranty
10.1 JMTP OG provides a warranty within the scope of the statutory provisions. For complaints, please contact support@jmtp.at.
10.2 The Provider may require the Customer, where reasonably feasible, to send the defective Products to the Provider, in which case the Provider bears the risk of transit and the cost of return shipping. The Customer is asked to report any goods delivered with obvious transport damage to the delivery service and to inform the Provider accordingly. Failure by the Customer to do so has no effect whatsoever on the Customer's warranty claims.
11 Liability and Damages
11.1 The Provider's liability for damages caused by slight negligence is excluded, except for personal injury and breaches of essential contractual obligations. Liability is further excluded for pure financial loss, loss of profit, damages suffered by third parties, indirect damages, and consequential damages arising from defects. The liability-limiting or liability-excluding provisions of this Section 11 do not apply insofar as the Provider is guilty of gross negligence or intent.
12 General Provisions
12.1 Insofar as Austrian law does not already apply due to this Webshop's focus on Austria, the applicability of Austrian law to the exclusion of the UN Convention on Contracts for the International Sale of Goods is agreed as exclusively applicable.
12.2 For consumers, this choice of law applies only to the extent that it does not deprive the consumer of protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
12.3 The Customer may only set off claims against the Provider's claims if the claims are legally connected to the Provider's claims, have been acknowledged, or have been judicially established.
12.4 The Customer is obligated to notify the Provider of any change of address. If the Customer fails to notify a change of address, a declaration sent by the Provider to the last known address shall nevertheless be deemed to have been received by the Customer.
13 Withdrawal Instructions Right of Withdrawal / Right of Rescission
The term commonly used in Austria, "Rücktrittsrecht," corresponds to the term commonly used in Germany and used in the EU Consumer Rights Directive, "Widerrufsrecht." We therefore use the equivalent pair of terms "right of withdrawal (right of rescission)." In these withdrawal instructions, only the term "right of withdrawal" is used. This is synonymous with the Austrian term "right of rescission."
No Right of Withdrawal (Rescission) There is no right of withdrawal (rescission) for goods that are manufactured to Customer specifications or are clearly tailored to personal needs.
There is no right of withdrawal (rescission) for goods that are liable to deteriorate or expire quickly.
There is no right of withdrawal (rescission) for newspapers, periodicals, or magazines (except for subscription contracts).
Lapse of the Right of Withdrawal (Rescission) The right of withdrawal (rescission) lapses for goods delivered sealed which are not suitable for return for reasons of health protection or hygiene, if the goods have been unsealed after delivery.
The right of withdrawal (rescission) lapses for audio or video recordings such as CDs, DVDs, etc., as well as for computer software delivered in a sealed package, if the goods have been unsealed after delivery.
The right of withdrawal (rescission) lapses for goods which, after delivery, have been inseparably mixed with other goods due to their nature.
Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period shall be fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item of goods.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, although this is not mandatory.
You may also exercise your right of withdrawal online at https://jmtp.at/pages/widerruf-formular. If you use this online option, we will send you an acknowledgment of receipt without delay on a durable medium (e.g. by email), including information on the content of the withdrawal declaration and the date and time it was received.
To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees as a result of this reimbursement.
We may withhold reimbursement until we have received the goods back, or until you have provided proof that you have returned the goods, whichever is earlier.

without delay and in any case no later than fourteen days from the day on which you inform us of your withdrawal from this contract.
The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct cost of returning the goods.
You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for establishing their nature, characteristics, and functioning.
